These Terms of Service (“Terms”) govern your access to and use of the Wear or Not website, web application, and related services (collectively, the “Service”).
By accessing or using Wear or Not, you agree to these Terms. If you do not agree to these Terms, do not use the Service.
1. About Wear or Not
Wear or Not is a social decision-support platform that allows users to share outfit or appearance-related options and receive opinions from people they choose to involve and, where available, the Wear or Not community.
Wear or Not provides opinions and feedback from other users. We do not guarantee the accuracy, quality, availability, or usefulness of any opinion, vote, recommendation, or other user-generated content.
2. Eligibility
You must be at least 13 years old to use Wear or Not.
If you are under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian where such permission is required by law.
By using the Service, you represent that you are legally permitted to enter into these Terms.
3. Accounts
Certain features may require you to create an account.
You agree to provide accurate information, maintain the security of your account credentials, and promptly update information that becomes inaccurate.
You are responsible for activity occurring through your account and should notify us if you believe your account has been accessed without authorization.
We reserve the right to suspend or terminate accounts that violate these Terms, threaten the security or integrity of the Service, or are used for fraudulent, abusive, or unlawful activity.
4. Outfit Requests and User Content
Wear or Not may allow you to upload photographs, images, comments, votes, messages, profile information, and other materials (“User Content”).
You retain ownership of your User Content.
By submitting User Content to Wear or Not, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, process, and otherwise use that content as reasonably necessary to operate, provide, secure, and improve the Service.
This license does not give Wear or Not ownership of your User Content.
You represent that you have the necessary rights and permissions to upload and share your User Content.
You may not upload content that violates another person's privacy, intellectual-property, publicity, or other legal rights.
5. Acceptable Use
You agree not to use Wear or Not to:
- Harass, threaten, abuse, impersonate, or exploit another person.
- Upload unlawful, fraudulent, defamatory, obscene, or otherwise prohibited content.
- Upload photographs or other content you do not have the right to share.
- Attempt to gain unauthorized access to another user's account or the Service.
- Interfere with or disrupt the operation or security of the Service.
- Use automated systems, scraping tools, bots, or similar technology to access the Service without our permission.
- Use Wear or Not to distribute spam or unsolicited commercial communications.
- Use the Service for any unlawful purpose.
We may remove content or restrict access when reasonably necessary to enforce these Terms or protect users and the Service.
6. Style Circles and Invitations
Wear or Not may allow users to create or participate in Style Circles and invite other people to provide opinions.
When you provide another person's contact information for an invitation, you represent that you are using that information for a legitimate invitation related to Wear or Not and not for harassment, spam, or other unauthorized purposes.
Receiving an invitation does not require the recipient to join or use Wear or Not.
Recipients may decline invitations and may opt out of applicable communications.
7. SMS/Text Messaging
If you provide your mobile phone number and affirmatively consent to receive SMS messages from Wear or Not, you agree that Wear or Not may send transactional or service-related text messages to the number you provided.
Messages may include Style Circle invitations, outfit opinion requests, account notifications, and other communications related to your use of the Service.
Message frequency varies. Message and data rates may apply.
You may opt out of SMS messages at any time by replying STOP. After opting out, you may receive a final message confirming your opt-out.

Consent to receive SMS messages is not a condition of purchasing any goods or services.
Carriers are not liable for delayed or undelivered messages.
Your use of SMS features is also subject to our Privacy Policy.
8. Community Opinions
Where community features are available, outfit requests or other User Content may be shown to other Wear or Not users for voting, comments, or feedback based on the privacy and sharing options associated with the request.
Opinions expressed by users belong to those users and do not represent the views of Wear or Not.
Wear or Not does not guarantee that a request will receive a particular number of responses or any responses at all.
9. Paid Features and Subscriptions
Wear or Not may offer paid subscriptions or premium features.
The price and features included with a paid offering will be displayed before purchase.
If you purchase a recurring subscription, you authorize the applicable payment provider to charge the subscription price and applicable taxes according to the billing frequency disclosed at purchase until the subscription is canceled.
You may cancel a recurring subscription through the applicable subscription or payment-management process. Unless otherwise required by law, cancellation prevents future renewal charges but does not retroactively refund amounts already paid.
We may change subscription pricing or features in the future. Where required, we will provide appropriate notice before changes apply to an existing subscription.
Payment processing may be performed by third-party payment or subscription providers and may be subject to their applicable terms.
10. Intellectual Property
Except for User Content, the Service—including its software, design, branding, logos, text, graphics, interfaces, and other materials—is owned by or licensed to Wear or Not and is protected by applicable intellectual-property laws.
These Terms do not grant you ownership of Wear or Not's intellectual property.
You may use the Service only for its intended purposes and in accordance with these Terms.
11. Privacy
Our collection and use of personal information is described in our Privacy Policy.
By using the Service, you acknowledge that information will be handled as described in that policy.
12. Third-Party Services
Wear or Not may rely on or integrate with third-party services, including hosting, authentication, storage, communications, payment, subscription, and other technology providers.
We are not responsible for third-party services that are outside our control. Your use of certain third-party services may also be subject to their terms and policies.
13. Service Availability and Changes
We may modify, update, suspend, or discontinue portions of Wear or Not from time to time.
We do not guarantee that every feature will always be available or that the Service will operate without interruption or error.
We may introduce, modify, or remove features as the Service evolves.
14. Disclaimer of Warranties
To the fullest extent permitted by applicable law, Wear or Not is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that opinions or recommendations received through the Service will produce any particular result.
Wear or Not is intended to help users gather opinions. Decisions made based on those opinions remain the responsibility of the user.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Wear or Not and its owners, operators, affiliates, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the Service.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
16. Termination
You may stop using Wear or Not at any time.
We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, created risk or potential legal exposure, engaged in fraudulent or abusive activity, or threatened the security or operation of the Service.
Provisions that by their nature should survive termination will continue to apply after termination.
17. Changes to These Terms
We may update these Terms periodically as Wear or Not evolves.
When changes are made, we may update the “Last Updated” date above. If a change materially affects your rights, we may provide additional notice where appropriate or required by law.
Continued use of the Service after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
18. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
